SOMETIMES, IT CAN ONLY TAKE A KID'S GAME TO SOLVE A BURNING QUESTION

From this morning's St. Petersburg Times, a story of a highly contenteous legal battle between the Orlando-based company Avista Management and Wausau Underwriters Insurance Company over a settlement from Hurricane Charley that has been in the legal system for more than a year.

The case itself it not that interesting...but what a judge did Tuesday regarding this case certainly was.

It seems as though the two sides just can't agree on anything, and that includes even the location to take a deposition. So they decided to ask Federal District Judge Gregory A. Presnell to decide for them.

The honourable Judge Presnell became so exasperated at the lawyers' inability to make even the simplest decision that he reached into his bag and filed an order that they shall meet at 4:00 PM on June 30. If the attorneys cannot agree on a suitable location, then they are to meet on the steps of the Tampa federal courthouse.

According to the Times story:

“At that time and location, counsel shall engage in one game of 'rock, paper, scissors,’” Presnell wrote. “The winner of this engagement shall be entitled to select the location for the … deposition.”

It's not entirely out of character for Presnell, who is known as being rather outspoken. In the meantime, Avista attorney David Pettinato says he plans to work on his moves with his two daughters, ages 5 and 9.
